Immigration Appeals
If you have been denied a green card or other visa, or a judge has ordered your deportation, you may have a right to appeal the decision, but you must get an attorney immediately. At Robichaud, Schroepfer & Correia, P.A., our lawyers are fully qualified to handle appeals before both the U.S. Board of Immigration Appeals (BIA) and the Federal District Courts.
Just about every decision is appealable, but you have a very limited time period to file an appeal or you may forever lose the opportunity. There are two types of immigration appeals:
- Affirmative appeals in response to a denial of your green card application
- Defensive appeals in response to a removal proceeding
The appeals process can take a long time, during which time you would be allowed to remain in the United States and may even be eligible for work authorization.
