Pre-Nuptial and Post-Nuptial Agreements

Minnesota law recognizes the right of couples to decide their own terms for any divorce that may occur between them by a contractual agreement. We can help you ensure that your rights and interests are protected.

If this agreement occurs before the marriage it is called a Pre-Nuptial Agreement. If it occurs after the marriage it is called a Post-Nuptial Agreement. Minnesota law requires that both parties are represented by an attorney when making a Post-Nuptial Agreement. It is highly encouraged that both parties are represented by an attorney for a Pre-Nuptial Agreement.

Pre-Nuptial and Post-Nuptial Agreements typically involve the division of marital property and the amount and duration of any spousal maintenance.
